AGREEMENT AND RELEASE FROM LIABILITY 1. Voluntary Participation. I, ___________________________(Print Name)], acknowledge that I have voluntarily applied to participate in the benefit walk which was organized by ONEkind Foundation at the premises of Rancho Buena Vista High School, located at 1601 Longhorn Drive, Vista, California. 2. Assumption of Risk. I AM AWARE THAT WALKING IN SUCH AN EVENT IS A POTENTIALLY HAZARDOUS ACTIVITY. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, AND I HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH, AND VERIFY THIS STATEMENT BY PLACING MY INITIALS HERE: ___________. 3. Release. As consideration for being permitted by ONEkind Foundation to participate in these activities and use related facilities, I hereby agree that I, my assignees, heirs, guardians, and legal representatives will not make a claim against, sue, or attach the property of ONEkind Foundation, Rancho Buena Vista High School, the City of Vista, or any of their principals, employees or representatives on account of injury or damage resulting from the negligence or other acts, howsoever caused, by myself or anyone else as a result of my participation in such walking event. I hereby release ONEkind Foundation, Rancho Buena Vista High School, the City of Vista, and any and all of their principals, employees or representatives from all actions, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or may hereafter have for injury or damage resulting from my participation in such organized walk. 4. Knowing and Voluntary Execution. I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN ME AND ONEkind FOUNDATION AND SIGN IT OF MY OWN FREE WILL. Executed on _____________(DATE) at Vista, California.
